These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer") and Central PA Septic Service ("Company"). By accessing this website, requesting an estimate, or authorizing service, you agree to be bound by these Terms.

1. Services and Site Conditions

The Company provides septic pumping, inspections, and maintenance. We reserve the right to refuse service if site conditions are deemed unsafe for our personnel or equipment. Services are subject to weather conditions and physical accessibility of the septic system.

2. Estimates and PA HICPA Compliance

Estimates provided via phone or web are preliminary. Final pricing is determined after an on-site evaluation. For residential services exceeding $500, work shall be performed in accordance with the Pennsylvania Home Improvement Consumer Protection Act (HICPA), and a separate written contract may be required.

3. Customer Responsibilities & Property Access

Customer warrants they have the legal authority to authorize work on the property. Customer is responsible for providing clear access for service vehicles. Customer must identify and mark all private underground utilities (e.g., dog fences, sprinkler lines, private electric) not covered by the PA One Call system. The Company is not liable for damage to unmarked private lines.

4. Hidden Conditions

The Company is not responsible for unforeseen subsurface conditions, including but not limited to: rock formations, high water tables, or collapsed baffles discovered during pumping/inspection. Encountering such conditions may result in additional charges or work stoppage.

5. Payment and Collection

Payment is due upon completion of service unless prior credit terms are established. Late balances are subject to a fee of 1.5% per month. Customer agrees to pay all costs of collection, including reasonable attorney fees, should legal action be required to recover unpaid balances.

6. Cancellations and Trip Charges

Please provide 24-hour notice for cancellations. If the Company arrives on-site and cannot perform service due to lack of access or inaccurate property info provided by the Customer, a "Dry Run" trip charge will apply.

7. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL SERVICES ARE PROVIDED "AS IS." THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THE REMAINING LIFE EXPECTANCY OF ANY SEPTIC SYSTEM.

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL CENTRAL PA SEPTIC SERVICE BE LIABLE FOR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICE IN QUESTION. THE COMPANY IS NOT RESPONSIBLE FOR NORMAL WEAR AND TEAR TO DRIVEWAYS, LAWNS, OR VEGETATION RESULTING FROM THE OPERATION OF SERVICE VEHICLES.

9. Indemnification

Customer agrees to indemnify and hold the Company harmless from any claims, damages, or legal fees arising from Customer�s failure to disclose site hazards or lack of legal authority to authorize the requested services.

10. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any legal proceedings arising from these Terms shall be brought exclusively in the courts of the county where the Company�s principal place of business is located.
